Florida Wrongful Death Actions
Florida's Wrongful Death Act allows the personal representative of an estate to bring a single action on behalf of the estate and surviving family members. Who may recover, and for what, is defined by statute and depends on the relationship to the decedent and in some circumstances their age.
These requirements are procedural, but getting them wrong has substantive consequences. Establishing the estate, appointing a representative, and identifying survivors correctly all must happen before the claim can proceed properly.
